“Canada has again tightened tax regulations because so-called stapled investment entities have managed to circumvent its income trust taxes. On Hallowe'en 2006, Ottawa announced new taxes on cash distributions to unitholders of income trusts so as to reduce their payout edge over operating companies. It called the new policy the Tax Fairness Plan.
Since these tax changes became effective this year, investors seeking high yields have bought alternatives to income trusts, stapled securities, which are two separate products, equity and debt, that trade on exchanges together. This could offer tax advantages similar to those of income trusts. Because interest on business debt is deductible for income tax purposes, the bond interest shelters part of the company's taxable income.
But now, the rules will stop a company or trust deducting the interest paid on the debt part of a stapled security. Many newsletters aiming at US yield investors failed to anticipate a followup to the Hallowe'en Surprise. We figured it would be coming.”
